1. That the person who is obliged to pay the rental income becomes unemployed, Temporary Employment Regulation File (ERTE), or has reduced his working hours due to care
In the case of being an entrepreneur, or other similar circumstances that involve a substantial loss of income, thus not reaching the total income of the members of the family unit, in the month prior to the request for the moratorium:
- In general, the limit of three times the monthly Public Indicator of Multiple Effects Income (hereinafter IPREM).
- This limit will be increased by 0.1 times the IPREM for each dependent child in the family unit. The applicable increase per dependent child will be 0.15 times the IPREM for each child in the case of a single-parent family unit.
- This limit will be increased by 0.1 times the IPREM for each person over 65 who is a member of the family unit. In the event that any of the members of the family unit has a declared disability greater than 33 percent, a situation of dependency or an illness that accreditably disables them permanently to carry out a work activity, the established limit will be four times the IPREM, without loss of accumulated increases per dependent child.
In the case that the person obliged to pay the rent is a person with cerebral palsy, mental illness, or intellectual disability, with a recognized degree of disability equal to or greater than 33 percent, or person with physical or sensory disability, With a recognized degree of disability equal to or greater than 65 percent, as well as in cases of serious illness that accreditedly incapacitates the person or their caregiver to carry out a work activity, the expected limit will be five times the IPREM.
2. That the rental income, plus expenses and basic supplies, is greater than or equal to 35 percent of the net income received by all the members of the family unit. For these purposes, "basic expenses and supplies" will be understood as the amount of the cost of the supplies of electricity, gas, oil for heating, running water, fixed and mobile telecommunications services, and possible contributions to the community of owners , all of them of the habitual residence that corresponds to satisfy the tenant.
3. That no member of the family unit that lives in the home is the owner of a home in Spain. For these purposes it will be considered that a person is not the owner or beneficial owner of a home:
- If the right rests only on a proportional part of it and has been obtained by inheritance or by transfer due to death without a will.
- Those who, being owners of a home, certify that it is not available due to separation or divorce, for any other cause beyond their control.
- When the home is inaccessible due to the disability of its owner or of any of the people who make up the coexistence unit.
4. None of the people in the family unit is related in the first or second degree by consanguinity or affinity with the landlord of the home
5. None of the members of the family unit is a partner or participant of the natural or legal person acting as lessor.
6. Applicants are up to date with their tax and Social Security obligations.
